Welcome to Kathari Era.

These Terms of Service (“Terms”) apply when you visit our website, place an order with us, or otherwise use our online services. 
This website is hosted on Shopify Inc. and operated by Kathari Era. By accessing our website or placing an order, you agree to these Terms. Please read them carefully before making a purchase. 
Kathari Era is an Ireland-based brand inspired by Indian craftsmanship, traditional techniques and the people and stories behind them.
These Terms should be read together with our Legal Notice, Privacy Policy and Refund & Returns Policy, which form part of the information governing your use of our website and your purchases from us.

1. Using Our Website
You agree to use our website lawfully and responsibly.
You must not use our website for fraudulent, unlawful or abusive purposes, attempt to interfere with its operation or security, introduce malicious code, attempt to gain unauthorised access tour systems/information or infringe the rights of Kathari Era or any third party.
We reserve the right to restrict or suspend access to our website where we reasonably believe these Terms have been breached or where necessary to protect our website, business or customers.

2. Our Products
Kathari Era offers products inspired by traditional Indian craftsmanship, including handcrafted textiles, accessories, clothing, homeware and other lifestyle products.
We make reasonable efforts to ensure that product descriptions, photographs, measurements, colours and other information displayed on our website are accurate.
However, many of our products are handmade or produced using traditional techniques. As a result, individual pieces may have natural variations in:
colour; print placement, pattern, texture, stitching, embroidery, quilting, other aspects of their finish.

These variations may make each piece individual and are not, by themselves, considered defects where the product otherwise conforms to its description and the sales contract.
Nothing in these Terms limits your statutory rights where a product is faulty, not as described or not fit for purpose.

3. Product Availability
Our products may be available in limited quantities or small batches.
We reserve the right to discontinue, replace or modify a product at any time.
Where a product becomes unavailable after you have placed an order, we will contact you and, where appropriate, offer an alternative or provide a refund for the unavailable product.
We will not substitute a product without your agreement where doing so would materially change your order.

4. Prices
All prices displayed on our website are in Euro (€) unless otherwise stated.
Any applicable delivery charges will be shown before you complete your purchase.
We take reasonable care to ensure that prices displayed on our website are accurate. If we discover an obvious pricing error after you have placed an order, we will contact you before processing the order and give you the option to proceed at the correct price or cancel the order.
Prices may change from time to time. Any change will not affect an order that we have already accepted at the stated price.

5. Payment
Payment must be made using the payment methods available at checkout.
Payments may be processed through third-party payment providers. Your payment information may therefore be handled by those providers in accordance with their own terms and privacy policies.
By submitting payment details, you confirm that you are authorised to use the selected payment method.
We may refuse or cancel an order where we reasonably suspect fraudulent or unauthorised payment activity.

6. Orders and Acceptance
When you place an order through our website, you are making an offer to purchase the products selected by you.
An order acknowledgement confirms that we have received your order. Your order is accepted when we confirm that it is being processed for fulfilment.

We reserve the right to refuse or cancel an order in reasonable circumstances, including where:
* the product is unavailable;
* there is an obvious error in the product description or price;
* we are unable to fulfil the order;
* we reasonably suspect fraudulent activity; or
* cancellation is required by law.

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled order.

7. Delivery
We aim to dispatch orders as soon as possible.
Delivery times may vary depending on the delivery destination, courier and other circumstances outside our reasonable control (include serious transport disruption, strikes, natural events, government restrictions, widespread technical failures, telecommunications disruption or other events that could not reasonably have been prevented or anticipated.)
Where available, tracking information may be provided after dispatch.
If a delivery date has been agreed, we will make reasonable efforts to deliver your order by that date.
Where no specific delivery period has been agreed, Irish consumer law generally requires goods to be delivered without undue delay and, subject to applicable exceptions, no later than 30 days after the purchase/contract is entered into.

If your order has not been delivered within the applicable timeframe, please contact us so that we can investigate and work with you to resolve the issue.

8. International Orders, Customs and Import Charges
We may accept orders from customers outside Ireland where delivery is available at checkout.
The delivery charge shown at checkout covers the applicable courier service selected for the order. Customs duties, import taxes, local taxes or clearance charges imposed by the destination country are not included unless expressly stated at checkout.
Where such charges are imposed by the destination country or its authorities, they are the responsibility of the customer.
Customers are responsible for ensuring that products ordered from Kathari Era may legally be imported into their country.
Customs delays or requirements imposed by authorities may affect delivery times and are outside Kathari Era's reasonable control.

9. Returns/Refunds
Generally, refunds must be made using the same payment method used for the original transaction unless you agree otherwise.
We may withhold reimbursement until we have received the returned goods in original condition.

10. Faulty, Damaged or Incorrect Products
We want every Kathari Era product to reach you in the condition you expect.
If you receive an item that is faulty, damaged, incorrect, not as described or otherwise does not conform to the sales contract, please contact us as soon as reasonably possible.
Where goods do not conform to the sales contract, a short-term right to terminate the sale/contract and receive a refund where the right is exercised within 30 days of receiving the goods, subject to the applicable rules.
After the first 30 days, you may continue to have a repair, replacement, price reduction or refund depending on the circumstances and the nature of the problem.
We will not treat normal wear and tear, accidental damage or damage resulting from misuse or failure to follow reasonable care instructions as a product fault where the issue has been caused by such circumstances.

11. Handcrafted Products and Care
Many Kathari Era products are made using traditional or artisan techniques.
Small differences between individual products are part of the character of handcrafted goods. For example, hand block printing may result in slight differences in print placement or intensity, while hand embroidery, quilting and stitching may show minor variations.
We believe these characteristics contribute to the individuality of each piece.
Where specific care instructions are provided with a product, we recommend following them to help preserve its appearance and quality.
Damage resulting from improper washing, cleaning, storage, misuse, accidental damage or failure to follow care instructions may not be considered a manufacturing or product fault.

12. Sale and Promotional Products
Products offered at a reduced price remain subject to the same rights as products sold at full price.
A sale or promotional price does not remove your rights where a product is faulty, not as described or otherwise does not conform to the sales contract.
Where a product has a specific known defect and that defect has been clearly disclosed to you before purchase, your rights in relation to that disclosed issue may be affected as permitted by law.

13. Intellectual Property
The Kathari Era name, logo, brand identity, photography, written content, product descriptions, graphics, designs and other original website materials belong to Kathari Era or are used with appropriate permission. You should not reproduce, copy, modify, distribute, publish, commercially exploit or otherwise use our intellectual property without our prior written permission, except where permitted by law.

14. Reviews and Customer Content
If you voluntarily submit a review, photograph, testimonial, comments, feedback or other content to Kathari Era, you confirm that you have the right to provide that content and that it does not infringe another person's rights.Where you give us permission to use your content, we may use it for legitimate marketing and promotional purposes, including on our website and social media channels.
We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
You further agree that your comments will not contain libelous or unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments.

You remain responsible for the content you submit.

These third parties operate independently of Kathari Era and may have their own terms and privacy policies.

These Terms are governed by and interpreted in accordance with the laws of Ireland.
Nothing in these Terms affects any mandatory rights or protections you have under Irish or applicable European Union consumer law.
